Welcome to our AI Postcard Generator! These Terms of Service ("Terms") govern your access to and use of our website and services (“App”, “we”, “our”). By accessing or using our app, you agree to these Terms. If you do not agree, please do not use the service.

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your country) to use the app. If you are under 18, you must have parental or guardian permission.

2. Use of the Service

You may use our service to:

• Generate AI-powered postcards using your text and/or images
• Download or email the generated postcards
• Use optional paid features (e.g., premium styles, higher resolution) via Stripe

You agree not to:

• Use the service for illegal, harmful, or abusive purposes
• Upload content that is offensive, infringing, or violates any laws
• Attempt to reverse engineer or disrupt our systems or APIs

3. Accounts and Authentication

To use certain features, you may be required to log in using Google login via Firebase Authentication. By doing so, you agree that:

• You provide accurate and up-to-date information
• You are responsible for maintaining the confidentiality of your login credentials
• You will not share your login with others

We reserve the right to suspend or terminate accounts that violate these terms.

4. Payments

Some features may require payment through Stripe. By purchasing:

• You agree to Stripe’s Terms of Service and Privacy Policy
• All prices are displayed in USD, and include applicable taxes unless stated otherwise
• We do not store your payment information — Stripe handles all payments securely

Refund Policy At postcardly.com, we are committed to providing a unique and innovative experience through our AI-generated features. We understand that AI, while powerful and revolutionary, isn't perfect and may not always produce the results you expect. We want you to be fully aware of this inherent risk before making any purchases. Due to the high costs involved in powering the advanced GPUs for our AI art generation, we unfortunately cannot offer refunds once credits have been used. We realize this may not be the ideal scenario for everyone, but this policy helps us to maintain a fair and sustainable service for all of our valued users. We believe in transparency and want you to make an informed decision about our unique service. Your understanding and support mean a lot to us. As we continue to improve and enhance our AI, we hope you will join us in this fascinating journey of digital creativity.

5. Content Ownership

You retain rights to:

• The content you input (text and images)
• The AI-generated output (postcards), subject to applicable law and third-party model licenses

By using the app, you grant us a limited license to use your inputs for the sole purpose of generating and delivering the requested content, and optionally for improving the service (e.g. debugging, analytics).

You are responsible for ensuring your uploaded content does not violate copyright or privacy laws.

6. Availability and Changes

The app is provided on an “as-is” and “as-available” basis. We may:

• Modify or discontinue parts of the app at any time without notice
• Introduce new features or pricing changes
• Temporarily suspend access for maintenance or updates

We are not liable for any loss or damage resulting from downtime, errors, or modifications.

7. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages.
• Our total liability is limited to the amount you paid for the service in the past 3 months (if any).
• Use the app at your own risk. AI-generated results may not always be accurate, appropriate, or free of errors.

You may stop using the service at any time. We reserve the right to suspend or terminate access to the app if you violate these Terms.

9. Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of laws principles.
